QUOTE & SERVICE TERMS Wind River Environmental, LLC ("WRE")
1. Scope, Pricing & Site Conditions: This quote includes only the services described and is valid for 30 days. Pricing is based on information available at the time of quoting and may be adjusted to reflect actual site conditions, including tank size, volume, access, and fuel costs. Additional services or work outside the quoted scope require customer authorization and will be billed separately. Conditions discovered during service - such as inaccessible equipment, delays, undisclosed site conditions, or unforeseen system issues - may require additional work billed on a time and materials basis.
2. Estimates & System Conditions: Any recommendations or findings are based on conditions observed at the time of service. Septic systems are dynamic, and WRE cannot guarantee that a specific repair will resolve all issues. Routine services (including pump-outs and standard inspections) are not comprehensive system evaluations. Some components or defects may not be visible or detectable at the time of service. Additional issues may be identified once work begins.
3. Permits & Regulatory Requirements: Where permits are required, it is the customer’s responsibility to obtain them unless otherwise agreed in writing. WRE will not perform permitted work without a valid permit. WRE may assist with the process but is not responsible for permitting delays.
4. Customer Responsibilities & Site Access: Customer represents they are authorized to approve the work and agrees to provide safe, clear, and unobstructed access to all service areas. Customer acknowledges that service vehicles and equipment are required to access the site. While WRE exercises reasonable care, certain surfaces (including soft ground, driveways, and landscaped areas) may be susceptible to damage from normal operations. Customer is responsible for identifying and disclosing all underground utilities, private lines, irrigation systems, and subsurface structures. WRE is not responsible for damage to unmarked or undisclosed items.
5. Payment, Deposits & Cancellation: Payment is due upon completion unless otherwise agreed. Customer authorizes WRE to charge the card on file for completed services and agreed deposits. Deposits may be required for certain services and are non-refundable if canceled within 48 hours of the appointment or if access is not provided. Late balances may incur charges up to 1.5% per month from the date of default on past due balance, pre-litigation and post-judgement. In addition to the 1.5%, you will also incur any document recording costs, collection costs, attorneys' fees and court costs.
6. Surcharges & Fees: Fuel, energy, environmental, and other applicable surcharges may apply and are subject to change. The Environmental Compliance Fee is retained by WRE and is not a government-imposed charge. Current surcharge policies are available at www.wrenvironmental.com/policies/.
7. Emergency & Unscheduled Services: Same-day, after-hours, or on-call services are billed at emergency rates.
8. Property Conditions & Service Impact: Septic and liquid waste services may result in temporary odors, noise, and surface disruption, including disturbance to soil and landscaping. These are normal conditions of the work. WRE is not responsible for pre-existing structural issues, undisclosed hazards, or conditions beyond its control. WRE will use reasonable care to protect customer property.
9. Customer-Caused Conditions: WRE is not responsible for system failures or damage caused by misuse, including improper materials, excessive water use, or failure to follow recommended maintenance.
10. Advanced Systems & Ongoing Obligations: Customers with advanced treatment systems may be subject to ongoing regulatory maintenance and reporting requirements. Customer is responsible for compliance unless a separate service agreement is in place.
11. Compliance & Insurance: WRE performs services in accordance with applicable laws and maintains general liability insurance of not less than $1,000,000 per occurrence.
12. Force Majeure & Limitation of Liability: WRE is not liable for delays or failure to perform due to events beyond its control. To the fullest extent permitted by law, WRE is not liable for indirect or consequential damages. WRE’s total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim.
13. Indemnification: Customer is responsible for damages or claims arising from inaccurate, incomplete, or undisclosed property information or site conditions.
14. General Terms: WRE does not perform work in crawl spaces. This agreement is governed by the laws of the state where services are performed. Disputes may be resolved through binding arbitration at WRE’s option.
